Terms of Service for Yuragi

Welcome to Yuragi. These Terms of Service ("Terms") govern your access to and use of our application, websites, and services (the "Service"). Please read them carefully. By creating an account or using our Service, you agree to be bound by these Terms.

1. Your Agreement with Yuragi

These Terms constitute a legally binding agreement between you and the operator of Yuragi ("we," "us"). Your use of the Service is also governed by our Privacy Policy and our Community Guidelines, which are incorporated here by reference.

2. Your Account and Responsibilities

• Age Requirement: You must be at least 13 years old (or the age of legal consent in your country) to use Yuragi.
• Account Security: You are responsible for safeguarding your account. Keep your password confidential and notify us immediately if you suspect any unauthorized use of your account.
• Accurate Information: You agree to provide us with accurate information during registration and to keep it updated.

3. Content and Community

Yuragi is a space for conversation, not a free-for-all. We have rules to ensure the safety and comfort of our community.

• You Own Your Content: You retain all ownership rights to the text, images, and other content you create on the Service ("Your Content").
• Our License to Your Content: By posting Your Content, you grant Yuragi a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it as necessary to provide and operate the Service. For example, we need this license to show your Spark to other users.
• Community Guidelines: You agree to abide by our Community Guidelines at all times. These guidelines outline our rules against harassment, hate speech, spam, impersonation, illegal content, and other harmful behavior. Violating these guidelines is a violation of these Terms.
• Prohibited Conduct: You may not interfere with the Service, attempt to gain unauthorized access to our systems, scrape data from the Service without our permission, or use the Service for any illegal purpose.

4. Our Rights

To protect our community and operate our Service, we reserve the following rights:

• We may, but are not obligated to, review or remove any content that we believe violates our policies.
• We may suspend or terminate your account at any time for any reason, particularly if you violate these Terms or our Community Guidelines.
• We may change, suspend, or discontinue the Service at any time.

5. The "Echoes" Feature

The "Echoes" feature is your private, personal journal. We consider this content to be confidential. We will not access, view, or share your Echoes with any third party, except in the rare circumstances where we are compelled by law or where it is strictly necessary to investigate a critical security threat or a severe violation of our policies originating from that content.

6. The "Stewardship" Model (Donations)

Yuragi is free to use. Its continued operation is funded by the voluntary support of its community.

• Voluntary: All donations are completely voluntary.
• No Special Privileges: Donating does not entitle you to any special features, rights, customer support priority, or ownership in the Service. It is a gift to support the community.
• Non-Refundable: All donations are final and non-refundable.

7. Disclaimers and Limitation of Liability

• "As Is" Service: The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee that the Service will always be safe, secure, or error-free.
• Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, YURAGI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

8. Termination

You are free to stop using our Service at any time. You can terminate this agreement by deleting your Yuragi account. We may also terminate this agreement by suspending or deleting your account if you breach these Terms.

9. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

We hope to resolve any disagreements you have with us amicably. However, if we cannot, you and Yuragi agree to resolve any claim, dispute, or controversy arising out of or in connection with these Terms through final and binding arbitration. This applies to all claims under any legal theory, with the exception of claims brought in small claims court or for injunctive relief to stop unauthorized use or abuse of the Service or intellectual property infringement.

You agree that you may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, and private attorney general actions are not allowed.

10. General Terms

These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Yuragi. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
